El Colegio de Abogados y FEPUT rechazaron las reformas judiciales aprobadas por la Legislatura
Desde la Federación de Entidades Profesionales Universitarias de Tucumán solicitamos al Presidente de la Honorable Legislatura de Tucumán, Cr. Osvaldo Jaldo, la vuelta a Comisión del proyecto de Ley que busca modificar las leyes Nº 8983, 6238 y derogación de la Ley 9486, debido a que consideramos necesaria la consulta con el Colegio de Abogados, Universidades y otros profesionales idóneos en el tema.
Asimismo consideramos que la creación de una tasa, para los exámenes de ADN, podría ir en contra de normativas ya vigentes.

Rechazo a las leyes sancionadas recientemente por la Honorable Legislatura de la Provincia
El Colegio de Abogados de Tucumán, a través de su Consejo Directivo en forma unánime, en su carácter de persona de derecho público con categoría de Organismo de la Administración de Justicia (Ley 5233) y garante del Estado de Derecho, objeta y repudia la práctica adoptada por la Honorable Legislatura de Tucumán para la creación y sanción de los proyectos de ley ingresados en su seno bajo expedientes N°158-PL23 y N°159-PL23, los que ingresaron el día 15/09/23, obtuvieron dictamen de Comisión el día lunes 18/09/23 y fueron sancionados el día 20/09/23, colocando a esta Institución en un incumplimiento forzado, por imposibilidad material, de la obligación legal de participar en el proceso de elaboración de normas atinentes al debido funcionamiento de la Administración de Justicia (art. 21 inciso 5 de la Ley 5233).
Las leyes sancionadas recientemente por la Honorable Legislatura de la Provincia, afectan gravemente los derechos de los ciudadanos, creando una grave inseguridad e incertidumbre jurídica desde el momento en que los principales operadores del Derecho no participaron en el proceso de creación, opinión y control de constitucionalidad de las mismas.
Resulta insoslayable señalar que la envergadura y las repercusiones sociales y profesionales de las iniciativas sancionadas hubiesen requerido abrir un periodo de consulta sobre las políticas relativas al servicio de justicia, en el cual participen este Colegio de Abogados, el Colegio de Abogados del Sur, la Asociación de Magistrados de la provincia y la Academia a través de las autoridades de las Universidades de Tucumán (UNT, UNSTA, USPT, Siglo XXI) para que en un tiempo razonable manifiesten su opinión, resultando absolutamente contradictorias las públicas declaraciones del Legislador Raúl Ferrazzano, a tenor del exiguo plazo transcurrido desde el ingreso de los proyectos hasta la aprobación y su sanción.
Los ejes centrales de las reformas atentan contra el ejercicio profesional de los Abogados y poco ofrecen a los ciudadanos. El desafío es la modificación de las estructuras del sistema para poder adaptarlo a los tiempos que corren. Esos cambios no deben ser el resultado de imposiciones que dejen de lado la vigencia de principios y garantías establecidos en nuestra Constitución Nacional y normas dictadas en su ABOGADOS Consecuencia, sancionándose normas que se encuentran en franca contradicción con la institucionalidad vigente.
